These Terms of Service ("Terms") govern your use of the PrimeTri application ("the App") provided by Exultnet LLC ("we", "us", "our"). By using the App, you agree to these Terms.

1. Use of the App

PrimeTri is a triathlon training application that uses AI to generate personalized training plans. The App is provided for informational and planning purposes only.

2. Medical Disclaimer

PrimeTri is not a medical device and does not provide medical advice. The training plans, coaching suggestions, and workout recommendations generated by the App are for general fitness planning purposes only. You should:

• Consult a physician before starting any training program
• Listen to your body and stop exercising if you feel pain, dizziness, or discomfort
• Not rely solely on AI-generated plans for training decisions
• Seek professional coaching for specific medical conditions or injuries

We are not liable for any injuries, health issues, or damages resulting from following training plans generated by the App.

3. AI-Generated Content

Training plans and coaching feedback are generated by artificial intelligence. While we strive for accuracy, AI-generated content may contain errors or suboptimal recommendations. Use your judgment and experience when following any AI-generated plan.

4. Service Availability

The AI coaching features require an internet connection and depend on third-party services (Groq). We do not guarantee uninterrupted access to AI features. The App's local features (viewing plans, marking workouts) work offline.

5. Acceptable Use

You agree not to:

• Abuse the AI service by sending excessive or automated requests
• Attempt to reverse-engineer, modify, or interfere with the App's functionality
• Use the App for any unlawful purpose
• Circumvent rate limits or other protective measures

6. Intellectual Property

The App, its design, code, and content are owned by Exultnet LLC and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

7. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we handle your data.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, Exultnet LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the App.

10. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms are governed by the laws of the State of Illinois, United States, without regard to conflict of law provisions.
